The regulatory harmonization of cross-border flow of data aims to balance the need for value of cross-border flow of data in each country with the differences in the rules governing the regulation of cross-border flow of data,which is related to a country’s data security and national interests.Recently,China has begun to pay attention to the regulation of cross-border flow of data in free trade agreements concluded with foreign countries,but there are still many shortcomings in regulatory harmonization.China’s domestic regulatory rules have fitness barriers to international rules,a single way of engaging in regulatory harmonization,and a weak voice in regulatory harmonization practices.In the existing practice of international regulatory coordination,the U.S.exports U.S.regulatory rules on cross-border flow of data to its trading partners through the formulation of free trade agreements to gain a dominant position in regulatory coordination;the EU relies on the Sufficiency Protection Recognition Agreement(SPRA)to reach a unified regulatory standard on cross-border flow of data in order to grasp the initiative of regulatory coordination.The U.S.-European-led approach to regulatory harmonization of cross-border data flows does not meet the real needs of developing countries.China should establish a unified regulatory body for cross-border data flow at the national level,improve the cross-border data security regulatory mechanism,enrich the ways to participate in international regulatory coordination of cross-border data flow,enhance the flexibility of participation,construct a regulatory coordination mechanism of mutual recognition and mutual recognition within the industry,and provide China’s solutions for the global regulatory coordination of cross-border data flow. 展开更多

The Fourth Industrial Revolution has endowed the concept of state sovereignty with new era-specific connotations,leading to the emergence of the theory of data sovereignty.While countries refine their domestic legislation to establish their data sovereignty,they are also actively engaging in the negotiation of cross-border data flow rules within international trade agreements to construct data sovereignty.During these negotiations,countries express differing regulatory claims,with some focusing on safeguarding sovereignty and protecting human rights,some prioritizing economic promotion and security assurance,and others targeting traditional and innovative digital trade barriers.These varied approaches reflect the tension between three pairs of values:collectivism and individualism,freedom and security,and tradition and innovation.Based on their distinct value pursuits,three representative models of data sovereignty construction have emerged globally.At the current juncture,when international rules for digital trade are still in their nascent stages,China should timely establish its data sovereignty rules,actively participate in global data sovereignty competition,and balance its sovereignty interests with other interests.Specifically,China should explore the scope of system-acceptable digital trade barriers through free trade zones;integrate domestic and international legal frameworks to ensure the alignment of China’s data governance legislation with its obligations under international trade agreements;and use the development of the“Digital Silk Road”as a starting point to prioritize the formation of digital trade rules with countries participating in the Belt and Road Initiative,promoting the Chinese solutions internationally. 展开更多

Nowadays,data are more and more used for intelligent modeling and prediction,and the comprehensive evaluation of data quality is getting more and more attention as a necessary means to measure whether the data are usable or not.However,the comprehensive evaluation method of data quality mostly contains the subjective factors of the evaluator,so how to comprehensively and objectively evaluate the data has become a bottleneck that needs to be solved in the research of comprehensive evaluation method.In order to evaluate the data more comprehensively,objectively and differentially,a novel comprehensive evaluation method based on particle swarm optimization(PSO)and grey correlation analysis(GCA)is presented in this paper.At first,an improved GCA evaluation model based on the technique for order preference by similarity to an ideal solution(TOPSIS)is proposed.Then,an objective function model of maximum difference of the comprehensive evaluation values is built,and the PSO algorithm is used to optimize the weights of the improved GCA evaluation model based on the objective function model.Finally,the performance of the proposed method is investigated through parameter analysis.A performance comparison of traffic flow data is carried out,and the simulation results show that the maximum average difference between the evaluation results and its mean value(MDR)of the proposed comprehensive evaluation method is 33.24%higher than that of TOPSIS-GCA,and 6.86%higher than that of GCA.The proposed method has better differentiation than other methods,which means that it objectively and comprehensively evaluates the data from both the relevance and differentiation of the data,and the results more effectively reflect the differences in data quality,which will provide more effective data support for intelligent modeling,prediction and other applications. 展开更多

Characteristics of the Internet traffic data flow are studied based on the chaos theory. A phase space that is isometric with the network dynamic system is reconstructed by using the single variable time series of a network flow. Some parameters, such as the correlative dimension and the Lyapunov exponent are calculated, and the chaos characteristic is proved to exist in Internet traffic data flows. A neural network model is construct- ed based on radial basis function (RBF) to forecast actual Internet traffic data flow. Simulation results show that, compared with other forecasts of the forward-feedback neural network, the forecast of the RBF neural network based on the chaos theory has faster learning capacity and higher forecasting accuracy. 展开更多

This paper proposes a method of data-flow testing for Web services composition.Firstly,to facilitate data flow analysis and constraints collecting,the existing model representation of business process execution language(BPEL)is modified in company with the analysis of data dependency and an exact representation of dead path elimination(DPE)is proposed,which over-comes the difficulties brought to dataflow analysis.Then defining and using information based on data flow rules is collected by parsing BPEL and Web services description language(WSDL)documents and the def-use annotated control flow graph is created.Based on this model,data-flow anomalies which indicate potential errors can be discovered by traversing the paths of graph,and all-du-paths used in dynamic data flow testing for Web services composition are automatically generated,then testers can design the test cases according to the collected constraints for each path selected. 展开更多

The core of this language is predicate data flow diagram (PDFD). In order to eliminate the ambiguity of predicate data flow diagrams and their associated textual specifications, a formalization of the syntax and semantics of predicate data flow diagrams is necessary. In this paper we use Z notation to define an abstract syntax and the related structural constraints for the PDFD notation, and provide it with an axiomatic semantics based on the concept of data availability and functionality of predicate operation. Finally, an example is given to establish functionality consistent decomposition on hierarchical PDFD (HPDFD). 展开更多

The digital development rights in developing countries are based on establishing a new international economic order and ensuring equal participation in the digital globalization process to achieve people's well-rounded development in the digital society.The relationship between cross-border data flows and the realization of digital development rights in developing countries is quite complex.Currently,developing countries seek to safeguard their existing digital interests through unilateral regulation to protect data sovereignty and multilateral regulation for cross-border data cooperation.However,developing countries still have to face internal conflicts between national digital development rights and individual and corporate digital development rights during the process of realizing digital development rights.They also encounter external contradictions such as developed countries interfering with developing countries'data sovereignty,developed countries squeezing the policy space of developing countries through dominant rules,and developing countries having conflicts between domestic and international rules.This article argues that balancing openness and security on digital trade platforms is the optimal solution for developing countries to realize their digital development rights.The establishment of WTO digital trade rules should inherently reflect the fundamental demands of developing countries in cross-border data flows.At the same time,given China's dual role as a digital powerhouse and a developing country,it should actively promote the realization of digital development rights in developing countries. 展开更多

With its high repeatability,the airgun source has been used to monitor the temporal variations of subsurface structures. However,under different working conditions,there will be subtle differences in the airgun source signals. To some extent,deconvolution can eliminate changes of the recorded signals due to source variations. Generally speaking,in order to remove the airgun source wavelet signal and obtain the Green's functions between the airgun source and stations,we need to select an appropriate method to perform the deconvolution process for seismic waveform data. Frequency domain water level deconvolution and time domain iterative deconvolution are two kinds of deconvolution methods widely used in the field of receiver functions,etc. We use the Binchuan( in Yunnan Province,China) airgun data as an example to compare the performance of these two deconvolution methods in airgun source data processing. The results indicate that frequency domain water level deconvolution is better in terms of computational efficiency;time domain iterative deconvolution is better in terms of the signal-to-noise ratio( SNR),and the initial motion of P-wave is also clearer. We further discuss the sequence issue of deconvolution and stack for multiple-shot airgun data processing. Finally,we propose a general processing flow for the airgun source data to extract the Green 's functions between the airgun source and stations. 展开更多

Architectures based on the data flow computing model provide an alternative to the conventional Von-Neumann architecture that are widelyused for general purpose computing.Processors based on the data flow architecture employ fine-grain data-driven parallelism.These architectures have thepotential to exploit the inherent parallelism in compute intensive applicationslike signal processing,image and video processing and so on and can thusachieve faster throughputs and higher power efficiency.In this paper,severaldata flow computing architectures are explored,and their main architecturalfeatures are studied.Furthermore,a classification of the processors is presented based on whether they employ either the data flow execution modelexclusively or in combination with the control flow model and are accordinglygrouped as exclusive data flow or hybrid architectures.The hybrid categoryis further subdivided as conjoint or accelerator-style architectures dependingon how they deploy and separate the data flow and control flow executionmodel within their execution blocks.Lastly,a brief comparison and discussionof their advantages and drawbacks is also considered.From this study weconclude that although the data flow architectures are seen to have maturedsignificantly,issues like data-structure handling and lack of efficient placementand scheduling algorithms have prevented these from becoming commerciallyviable. 展开更多

Data sovereignty is the manifestation of national sovereignty in the digital field,which is also a matter of national security.While the U.S.ostensibly emphasizes the cross-border free flow of data,it actually implements the powerful policy of long-arm jurisdiction damaging the data sovereignty of other countries.On the other hand,the EU promotes European rules to the world in the name of advocating data protection,furthering data sovereignty through technological sovereignty.Russia asserts data sovereignty by adopting data localization measures.In order to adequately maintain data sovereignty in the cross-border flow of data as well,China should draw up the extraterritorial practice of relevant rules.In view of the problems to Chinese data sovereignty rules,we propose the concept of constructing such to strike a balance between data protection and data open,establish the jurisdictional rules of data sovereignty,determine the reasonable scope of applying data localization,and actively participate in the international legislation of data sovereignty.The proposal is also to provide a Chinese solution that is prudent and encouraging cooperation for global data sovereignty rules. 展开更多

Volatile nitrosamines (VNAs) are a group of compounds classified as probable (group 2A) and possible (group 2B) carcinogens in humans. Along with certain foods and contaminated drinking water, VNAs are detected at high levels in tobacco products and in both mainstream and side-stream smoke. Our laboratory monitors six urinary VNAs—N-nitrosodimethylamine (NDMA), N-nitrosomethylethylamine (NMEA), N-nitrosodiethylamine (NDEA), N-nitrosopiperidine (NPIP), N-nitrosopyrrolidine (NPYR), and N-nitrosomorpholine (NMOR)—using isotope dilution GC-MS/ MS (QQQ) for large population studies such as the National Health and Nutrition Examination Survey (NHANES). In this paper, we report for the first time a new automated sample preparation method to more efficiently quantitate these VNAs. Automation is done using Hamilton STARTM and Caliper StaccatoTM workstations. This new automated method reduces sample preparation time from 4 hours to 2.5 hours while maintaining precision (inter-run CV < 10%) and accuracy (85% - 111%). More importantly this method increases sample throughput while maintaining a low limit of detection (<10 pg/mL) for all analytes. A streamlined sample data flow was created in parallel to the automated method, in which samples can be tracked from receiving to final LIMs output with minimal human intervention, further minimizing human error in the sample preparation process. This new automated method and the sample data flow are currently applied in bio-monitoring of VNAs in the US non-institutionalized population NHANES 2013-2014 cycle. 展开更多

To resist such, China should turn from passivity into activity of also building a legal system for the extraterritorial application of domestic law in the field of cross-border data flow. 在数字经济快速发展与全球要素流动加速重构的背景下,数据作为新型战略性生产要素,其跨境流动在促进国际贸易合作、区域协同发展和技术创新扩散的同时,也将国家安全风险深度嵌入网络空间与全球产业链体系之中。“数据自由流动”与“国... 在数字经济快速发展与全球要素流动加速重构的背景下,数据作为新型战略性生产要素,其跨境流动在促进国际贸易合作、区域协同发展和技术创新扩散的同时,也将国家安全风险深度嵌入网络空间与全球产业链体系之中。“数据自由流动”与“国家安全”之间的结构性张力日益凸显,尤其是在复杂多变的国际地缘政治环境下,数据跨境流动已呈现出政治安全、经济安全、文化安全、科技安全等多维度交织的风险特征。基于此,本文从总体国家安全观视域出发,系统梳理数据跨境流动的安全内涵与治理逻辑,阐释总体国家安全观在政治安全、经济安全、数据主权与发展安全等维度对数据跨境流动风险治理的系统性指导意义,进而构建以安全与发展统筹为核心的风险治理分析框架。在此基础上,本文从宏观外部环境、中观制度机制与微观实践操作三个层面揭示数据跨境流动所面临的主要风险类型与挑战,并提炼中国特色数据跨境流动治理体系的核心特征与制度路径。研究认为,将总体国家安全观嵌入数据跨境流动治理实践,是实现开放合作与安全防控动态平衡的重要基础,也是完善我国数字安全治理体系、提升国家治理现代化水平的关键方向。 展开更多

为明确大流量条件下高速公路交通流特性,揭示交通流参数动态变化规律及相关关系,以广东省东莞市甬莞-莞佛高速公路(常虎高速)为研究对象,基于1周高精度ETC(电子不停车收费系统)门架数据,研究大流量条件下高速公路交通流量的时空特征、... 为明确大流量条件下高速公路交通流特性,揭示交通流参数动态变化规律及相关关系,以广东省东莞市甬莞-莞佛高速公路(常虎高速)为研究对象,基于1周高精度ETC(电子不停车收费系统)门架数据,研究大流量条件下高速公路交通流量的时空特征、车型差异化速度和流量分布特性,以及速度-流量的相关关系。研究结果表明,交通流量呈现显著的“M”型早晚高峰特征,工作日通勤高峰时段(8:00-10:00、16:00-18:00)流量峰值突出,周末则相对平缓;不同车型的流量分布差异明显,小客车占比最高,为69.4%,并且呈现典型的“双峰”模式,与通勤需求高度吻合,货车在夜间活跃度更高;行程速度分析表明,小客车速度显著高于中大型客车及各类货车;根据速度峰值对车型进行分类,采用分段函数分别对稳定流和拥堵流速度-流量进行拟合,拟合结果更加接近大流量高速公路真实情况。研究结果可为大流量高速公路精细化管理和动态交通控制提供理论依据和数据基础。 展开更多

文章聚焦全球数据跨境流动治理的核心问题,从制度创新、技术协同、场景适配三个维度构建理论分析框架,系统梳理欧盟、美国、中国三大治理范式特征,并以粤港澳大湾区为研究对象,剖析区域数据跨境流动治理障碍及完善路径。研究发现,当前... 文章聚焦全球数据跨境流动治理的核心问题,从制度创新、技术协同、场景适配三个维度构建理论分析框架,系统梳理欧盟、美国、中国三大治理范式特征,并以粤港澳大湾区为研究对象,剖析区域数据跨境流动治理障碍及完善路径。研究发现,当前数据治理变革呈现区域规则“阵营化”和“差异化”特征,技术无国界性与治理主权属性相互冲突,对制度创新提出迫切诉求。制度创新通过界定数据权利义务和引入适应性规则,奠定从秩序构建到风险防控的治理基础,与技术协同、场景适配共同构成治理效能提升的关键动力。在全球层面,欧盟形成“规制主导型”治理体系,通过规则互认平衡数据安全与流动;美国构建“技术主导型”模式,借助制度与技术协同维护数字霸权;中国建立“场景应用型”范式,通过数据分类分级统筹发展和安全。由于大湾区“一国两制三法域”的独特格局,粤港澳数据跨境流动存在法系规则冲突、技术标准不统一及产业数字化鸿沟的问题,需构建政策互通的跨区域协同治理模式,完善基础设施共享的技术保障体系,推进产业协同与跨境业务场景优化。文章为我国区域数据治理提供实践指引,亦为全球数据治理体系改革贡献中国方案。 展开更多

人工智能的发展离不开数据这一核心生产要素。数据的跨境流动在提升模型性能与多样性的同时,也带来了个人信息泄露、商业秘密外流和国家数据主权受损等安全风险。人工智能的风险在其全生命周期中逐级递增,具体体现在算法开发、服务提供... 人工智能的发展离不开数据这一核心生产要素。数据的跨境流动在提升模型性能与多样性的同时,也带来了个人信息泄露、商业秘密外流和国家数据主权受损等安全风险。人工智能的风险在其全生命周期中逐级递增,具体体现在算法开发、服务提供以及算力调用等环节。数据出境的技术路径复杂且存在监管盲区,导致现行监管框架面临技术规避行为和重要数据识别困境等现实问题。为构建安全与发展平衡的人工智能数据出境安全的监管体系,需建立能够动态响应风险的监管框架,通过建立数据分级响应机制与出境“白名单”制度,细化重要数据动态分类标准,并设立权责统一的监管主体,从而为我国人工智能产业全球化协作提供坚实的法治保障。 展开更多
